Conditions of Entry

Promotional Period

Start date - 5 June 2023 at 8:00AM (AEST)

End date - 3 July 2023 at 8:00AM (AEST)

Eligible Entrants

Entry is only open to Australian (excluding South Australian and ACT) residents who are 18 years and over.

Entrants must be able to attend the Eligible Match (as defined in the "Eligible Match" section below) at their own cost, noting the date, time and/or location of the Eligible Match may change. See the "Eligible Match" section below for more details.

Eligible Match

Round 19 – Rabbitohs vs Bulldogs Rugby League game on Saturday 8 July 2023 at Stadium Australia, Edwin Flack Avenue, Sydney Olympic Park, NSW, 2127, Australia.

If the above listed match does not go ahead or goes ahead without spectators, due to COVID-19 or any other unforeseen circumstances, the Game for the Eligible Match will be conducted at a different match at an alternative date, time and/or location as determined by the Promoter, and the alternative match or location determined by the Promoter will be considered the "Eligible Match" for the purposes of this Promotion.

How to Enter

To enter the Promotion, the entrant must, during the Promotional Period, visit rabbitohs.com, follow the Prompts to the Aqualand & Rabbitohs ‘Chance to Win an AURA by Aqualand Apartment’ 2023 Promotion, enter their personal details (first name, last name, email address, State, postcode and mobile phone number) and submit the fully completed entry form to register for the Promotion. Entrants will then get a confirmation email and an invite on how to get a Bonus Entry.

Bonus Entry: To receive one (1) bonus entry, the entrant must complete at least one (1) of the following Bonus Entry Methods during the Promotional Period:

Bonus Entry Method 1 - Facebook Entry:

a) upon entry form submission, click the link to Facebook as prompted on screen to be directed to the Aqualand Facebook page,

b) ‘like’ the promotional post;

c) follow Aqualand on Facebook; and

d) upon completion of the above steps, the entrant will be rerouted back to the promotional website and must again provide their details as prompted including their personal details requested, select the tick box to confirm their second entry, and submit the fully completed form to register for the Bonus Entry.

Bonus Entry Method 2: Instagram Entry:

a) upon entry form submission, click the link to Instagram as prompted on screen to be directed to the Aqualand Instagram page;

b) ‘like’ and share the promotional post to their Instagram story;

c) follow Aqualand on Instagram; and

d) upon completion of the above steps, the entrant will be rerouted back to the promotional website and must again provide their details as prompted including their personal details requested, select the tick box to confirm their second entry, and submit the fully completed form to register for the Bonus Entry.

Entries Permitted

Multiple entries permitted, subject to the following:

a) maximum of three (3) entries permitted per person in total, subject to the below;

b) limit one (1) entry permitted per person for entry form submission; and

c) maximum of two (2) Bonus Entries permitted per person (limit 1 entry for the Facebook Bonus entry mechanic; limit 1 entry for the Instagram Bonus entry mechanic).

Any entries (above limit specified above) from the same person/email/phone number and fraudulent entries will be disqualified.

Finalist Determination (three total)

a) A draw will be conducted at Hive Marketing Group, Suite 222, 117 Old Pittwater Rd, Brookvale NSW 2101 at 12:00 pm (AEST) on 3rd July 2023 using computerised random selection.

b) The first three (3) valid entries drawn (“Finalists”) will be required to participate in a Qualifying Activity in order to determine which entrant will take part in the Game for the chance to win an AURA by Aqualand Apartment valued at up to $1,110,000 AUD ("Major Prize"). The Qualifying Activity will take place during half time at the Eligible Match. The one (1) Finalist to successfully ’win’ against the other two (2) Finalists, based on the result of the Qualifying Activity will have the opportunity to take part in the Game (“the Player”).

c) The draw conductor may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn or a drawn participant cannot participate in the Qualifying Activity and/or the Game.

d) Details and rules of the Qualifying Activity, including requirements to ‘win’, will be communicated to Finalists prior to the start of the activity. The two (2) Finalists who do not proceed to play in the Game will each be awarded the consolation prize of one (1) Etymon dining voucher valued at $250 AUD each.

e) The three (3) Finalists will each be provided with two (2) tickets to the Eligible Match (if they do not already have a ticket) (with each ticket valued at $25). All costs associated with travel to and from the Eligible Match (including any applicable flights, accommodation, etc.) will be the responsibility of the Finalists and their guest.

f) Finalists unable or unwilling to attend the Eligible Match will forfeit their ability to participate in the Qualifying Activity and the Game.

g) The Promoter will list additional reserve entrants, in case of an invalid entry or entrant or in case an entrant cannot be contacted or in case a Finalist does not want to participate in the Qualifying Activity and Game (details outlined below).

h) If a Finalist cannot be contacted by 2pm (AEST) on 3rd July 2023, the Promoter will contact the next reserve finalist. This process will continue with each entrant having 2 hours (120 minutes) to call the Promoter back and accept participation in the Qualifying Activity and Game from the first phone call to them by the Promoter. If a Finalist fails to do so they will forfeit their right to participate in the Qualifying Activity and Game and therefore their opportunity to win a prize.

i) Under no circumstances whatsoever will a proxy or replacement participant be permitted to take part in the Qualifying Activity or Game, if the Finalist is unable to participate for any reason. An ID check may be carried out by the Promotional Staff prior to the Qualifying Activity and Game starting to ensure the Finalist is the correct eligible Qualifying Activity or Game participant.

Game Details

● The Game will be broadcasted on the ‘Big Screens at Stadium Australia’ at halftime at the Eligible Match on the 8th of July 2023. The Game will take place immediately after the Qualifying Activity.

● The Player will play the Game for a chance to win an AURA by Aqualand apartment valued at up to $1,110,000 AUD in the Game.

● There will be a numbered digital board with 40 x numbers on display which correlate to 40 envelopes at the start of the Game (each an “Envelope”). Each Envelope will contain an Aqualand themed icon (from the options in the below table). The Player may only select one (1) Envelope at a time. Once an Envelope is selected and revealed/opened, the Player cannot place this back or change their selection, and they will be required to reveal the Aqualand themed icon enclosed inside.

● As soon as the Player has revealed five (5) of the same Aqualand themed icons they will then win the respective prize outlined below for that corresponding Aqualand themed icon (subject to verification by the Promoter). The Game will then automatically conclude, and the Player will no longer be required to select any further Envelope/s.

● Only one (1) of either the Ultimate Prize, Grand Prize, Major Prize or Minor Prize will be awarded based on the outcome of the Game. All three (3) remaining prizes will not be awarded.

● If either the Ultimate Prize, Grand Prize or Major Prize is won in the Final Game in accordance with the rules above, the ‘Loss Adjuster’ removes all envelopes and takes them back for validation of the prize claim before the respective prize is awarded.

● If the Ultimate, Grand Prize or Major Prize is not won via the Game in accordance with the rules above, the ‘Loss Adjuster’ opens the ’control envelope’ which will reveal the five (5) Envelopes which contain the Ultimate Prize winning message/s inside. The ‘Loss Adjuster’ will then reveal on the Big Screen and opens the winning Envelopes to show the guests that the Ultimate Prize was in there and that the mechanic is fair and secure (should the Promoter request).

● A minimum of two Go-Pros and/or hand-held iPhones will be set up to take footage of the Qualifying Activity/Game, or preferably live coverage footage (Channel 9 or similar) and this will be supplied by Rabbitohs to an independent scrutineer, before a prize will be finally awarded.

● N.B. A Loss Adjustor must be present at the Game to ensure the Game is conducted as per these Conditions of Entry and any Game rules.

● The Grand, Major or Minor Prizes, if awarded, will be delivered via EFT to an Australian bank account in the Player’s name within 30 business days of the Game. The Player will be required to provide their Australian bank details to the Promoter in order for the Promoter to facilitate the award of the prize. If the Player fails to provide their bank account details by the date/time specified by the Promoter, they will forfeit their right to the prize.

● The details of the Qualifying Activity including any applicable conditions will be determined by the Promoter and provided to the Finalists prior to the start of the Qualifying Activity. The Finalists will be provided with an eligibility form explaining the rules of the Qualifying Activity which they must sign indicating their understanding and agreement to the rules, prior to participating in the Qualifying Activity.

● The Qualifying Activity/Game will be recorded and will be reviewed by an independent scrutineer, and a prize will only be awarded when/if there is no reasonable doubt the Qualifying Activity/Game was played fairly in accordance with the applicable rules, with no tampering by the Player.

Ultimate Prize Conditions

● The AURA by Aqualand Apartment means Apartment 5.01 in the development known as “AURA” at 168 Walker Street, North Sydney, NSW, 2060 currently being developed by AQUALAND NORTH SYDNEY DEVELOPMENT PTY LTD - ABN 60 603 278 379. AURA Apartment 5.01 is an off the plan one (1) bedroom apartment with no parking, valued at $1,110,000 AUD (the list price as at 5/04/23).

● Aqualand reserves the right to change the apartment number on the condition the revised apartment is valued at the same price and is equivalent to a one (1) bedroom AURA by Aqualand apartment with no car park. Aqualand will be responsible for any applicable statutory fees or charges in order to transfer the AURA by Aqualand apartment to the Ultimate Prize winner. Any other costs associated with the apartment, e.g., land tax, water/council rate, strata fees, insurance, furniture and fit out, electricity costs, conveyancing costs, legal fees and financing costs etc., will be the responsibility of the Ultimate Prize winner.

● The Ultimate Prize winner must consent to and sign any documents necessary in order to effect the transfer of the AURA by Aqualand Apartment to the Ultimate Prize winner.

● The AURA by Aqualand residential development is currently under construction, and the construction completion date is scheduled for mid-2024. The AURA by Aqualand Apartment 5.01 which is the Ultimate Prize is being built off the plan and the settlement date will be confirmed with the prize winner closer to the time of settlement. The Ultimate Prize winner may not nominate any other third party to acquire the Aqualand Apartment in its place.

Up to $1,110,650 AUD

Winner Notification

The three (3) Finalists will be notified within 1 hour of the draw via phone and email. The three (3) Finalists will be published at https://rabbitohs.ac-page.com/2023-win-an-aura-by-aqualand-apartment on Tuesday 4th July 2023. The Player will be published at https://rabbitohs.ac-page.com/2023-win-an-aura-by-aqualand-apartment on 9th July 2023.

1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

3. Valid and eligible entries will only be accepted during the Promotional Period listed in the Schedule above.

4. Employees (and their immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

5. If there are no prize winner/s or winner/s for this Promotion cannot be found, this information will be published at https://rabbitohs.ac-page.com/2023-win-an-aura-by-aqualand-apartment.

6. All reasonable attempts will be made to contact a Finalist or winner.

7. If any winner chooses not to take their prize (or is unable to) or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.

8. The value of the prize is accurate and based upon the recommended retail value of the prize (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize after that date.

9. No part of a prize is exchangeable or transferable, unless otherwise specified in writing by the Promoter.

10. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.

11. The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

12. Entrants' personal information will be collected by the Promoter and by Aqualand Projects Pty Ltd “Aqualand” (ABN: 73 169 346 810 of Level 37, 264 George St, Sydney NSW 2000 (“the Collectors”). Personal information will be stored on each of the Collector’s databases. The Collectors may use this information for future marketing purposes regarding their respective products, including contacting the entrant electronically. The Collectors are bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and their respective privacy policy which is located at https://www.rabbitohs.com.au/privacy-policy (for the Promoter) and https://www.aqualand.com.au/privacy-policy/ (for Aqualand). Each privacy policy contain information about how the entrant may access, update and seek correction of the personal information each of the Collectors holds about them and how the entrant may complain about any potential breach by either of the Collectors of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Collectors gather personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including their contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.

13. The Promoter reserves the right to refuse to allow a Finalist to take part in the Qualifying Activities/Game, if the Promoter determines in their absolute discretion, that a Finalist is not in the physical or mental condition necessary to be able to safely participate in the Qualifying Activities/Game in order to have a chance of winning the prize. It is a condition of participating in the Qualifying Activities/Game that the Finalist may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to participating.

14. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

15. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

16. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulations.

17. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

18. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.

19. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

20. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

21. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.

22. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

23. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
