Zoom "Kick for Cash" Terms and Conditions 2019

Zoom & Rabbitohs ‘Kick for Cash’ Competition (the “Promotion”) Terms & Conditions (the “Terms”)

Information on how to enter the Promotion and how to win the Prizes forms part of these Terms. Participation in this Promotion is deemed acceptance of these Terms.

1. Definitions.

In these Terms, unless the context indicates a contrary intention:

Draw Winner means an entrant who is selected to participate in a Game following their name being successfully drawn.

Eligible Match is the South Sydney Rabbitohs vs. Brisbane Broncos match on 2 May 2019 (kick off at 6.10pm) at ANZ Stadium – Edwin Flack Avenue, Sydney Olympic Park, NSW, 2127, Australia.

Game is the game played by the Winning Participant at half-time break of the Eligible Match.

Kicking Station means the designated station set up by the Promoter as part of the Game. See ‘’Set-up of Kicking Stations’’ section below for further details.

Participant means each five (5) Draw Winners.

Promoter is SOUTH SYDNEY DISTRICT RUGBY LEAGUE FOOTBALL CLUB LIMITED (ABN 28 002 487 390) of Level 4, 265 Chalmers Street Redfern, NSW 2016, Telephone (02) 8306 9900.

Promotional Period has the meaning set out in clause 2.

2.    Promotion Period

Promotion commences at 12:01am AEST on 29 April 2019 and ends at 3:00pm AEST on 30 April 2019 nationwide across Australia (“Promotional Period”).

3.    Eligible Entrants

(a) Entry is only open to all NSW residents aged 18 years of age or older who are available to attend the Event (defined above) and have tickets to the Event.

(b) Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

(c) The following persons are NOT eligible to enter this Promotion:

a. Anyone under the age of 18 years old;

b. Any professional, semi-professional, former professional, or collegiate player for any form of NFL, Football, Soccer, AFL, Rugby Union, Rugby League or other football format;

c. Anyone that has ever received, or been entitled to receive, more than AUD$20,000 in payment or reward (including match fees, sponsorship fees, cash, goods or services) for playing any form of NFL, Football, Soccer, AFL, Rugby Union, Rugby League or other football format; and

d. Anyone that has ever been a member of, or played on, any international NFL, Football, Soccer, AFL, Rugby Union, Rugby League or other football team.

4. How to Enter

(a) To enter, during the Promotional Period, the entrant must visit www.rabbitohs.com.au, follow the prompts to the Promotion entry page, enter their personal details (first name, last name, email address and mobile phone number), and submit the fully completed entry form.

(b) There is a limit of 1 entry permitted per person (and per email address and phone number). Multiple entries from the same person/email address/phone number and fraudulent entries will be disqualified.

(c) Entrants must be available to attend the Eligible Match.

5. Draws & Winner Notification

(a) The draw for the Eligible Match will take place prior to the game at Greeneagle Fulfilment & Distribution, Unit 5, 9 Fitzpatrick Street Revesby NSW 2212, on Wednesday 1 May 2019 2019 at 12.00pm AEST.

(b) The first five (5) valid entries randomly drawn will be deemed a Draw Winner and have the opportunity to participate in the Qualifying Game at the Eligible Match. For the sake of clarity, there will be five (5) Participants at the Game. The draw conductor will draw additional reserve entries in case of an invalid entry or entrant or in case a Draw Winner cannot be contacted or in case the Draw Winner does not want to participate in the Game.

(c) Draw Winners unable or unwilling to attend the Eligible Match will forfeit their ability to participate in the Game. Any costs associated with attending the Eligible Match including costs for travel to and from the Eligible Match will be the responsibility of the Participant.

(d) Draw Winners will be contacted on same day of the draw via phone and email. If a Draw Winner cannot be contacted by 2pm AEDT (NSW time) the day of the draw, the Promoter will contact the next reserve winner from the draw. This process will continue with each entrant having 2 hours (120 minutes) to call the Promoter back and accept participation in the Game from the first phone call to them by the Promoter. If a Draw Winner fails to do so they will forfeit their right to participate in the Game and therefore their opportunity to win a Prize.

6. Publication of Winners

Draw Winners will be published at www.rabbitohs.com.au on 3 May 2019.

7. Proxy or replacement participant

Under no circumstances whatsoever will a proxy or replacement for the Participant be permitted to take part in the Game if the Draw Winner is unable to participate for any reason. An ID check will be carried out by the Promoter’s promotional staff prior to the Game starting to ensure the drawn winner is the correct Participant.

8. Set up of the Kicking Stations

(a) Immediately before the game in the selected Match, the Rabbitohs/Zoom Promotional Staff will set up the Kicking Stations on the field.

(b) The Kicking Station will be set-up 30 meters from directly in-front and centre of the goal posts, in preparation for the Participant’s attempt.

(c) If for whatever reason, the lines are not marked on the field it is required that the Promotional Staff measure and record their measurement in one continuous, unbroken video recording (clearly showing the distance measured).

9. Qualifying Game (all 5 Participants will take part in the Qualifying Game)

(a) During half-time, the lucky Winner/s will driven out onto the pitch, play the Qualifying Game – whomever wins and is deemed the Winning Finalist will then get to attempt the CrossBar Challenge, for a chance to win $50,000 AUD.

10. The Game (only Winning Participant will take part in the Game)

(a) The Game will take place immediately after the Qualifying Game. The Winning Finalist will be given the chance to complete kick(s) on the playing field during the half time break of the Eligible Match to win a prize.

(b) Only the Winning Finalist will get to attempt to kick from 30m, and all other participants (x4) will not receive a prize.

a. The Winning Finalist will be placed at the 30m line and will be instructed to take their kick.

b. The Participant will have only 1 x attempt each and can choose to take the kick from a tee, on the ground or from their hands. Any further attempts will be disqualified.

11.  The Prizes

(a) The available prizes to be won are listed below. For the sake of clarity, the Winning Participant will only receive one (1) of the prizes listed below only based on their results from participation in the Game. See Game details above for details on how the prize awarded to the Winning Participant is determined.

(b) Participants’ performance in the Game will be reviewed by an independent scrutineer. Prizes are only awarded once results of the Game are successfully verified.  

(c) The Promoter will award the prize to the Winning Participant’s nominated bank account.

(d) The total maximum prize pool is up to $50,000 AUD (inc. GST).

12.  Qualifying a Successful Kick

A Successful Kick:

                                i. Must be kicked by the Participant from the Kicking Station and not moved closer or further from the goal or tampered with in any way before the Kick is made;

                               ii. Does not allow the Participant to have any practice kicks and the Participant may not touch any of the balls before instructed;

                              iii. The ball must travel from the Participants foot and hit the Crossbar post; and

                              iv. If the Promoter (and it’s third party providers) believes that the Participant has made a Successful Kick, it will be deemed a Successful Kick.

If the Promoter (and its third party providers) believe that the Winning Participant has made a Successful Kick, it will be deemed a Successful Kick (on the proviso the Promoter has supplied unequivocal evidence).

13. The Footage

A minimum of two Go-Pros and/or hand-held iPhones will be set up to take Footage of the Game attempted, or preferably live coverage footage (Channel 9 or similar) at this will be supplied by Rabbitohs to an independent scrutineer, before a prize will be finally awarded. The footage must show unequivocal evidence that the kick was achieved.

14. Unclaimed Prize Draw

(a)    If for any reason the Winning Finalist does not claim a prize by the date/time specified by the Promoter they will forfeit their right to the prize and the prize will not be re-awarded.

15. General

(a) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, tampered with the entry or Game process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

(b) Incomplete, indecipherable, inaudible or illegible entries (as applicable) will be deemed invalid.

(c) If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

(d) Subject to clause 14, if for any reason a winner does not take or redeem a Prize (or an element of the Prize) at or by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.

(e) Entrants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products hired, distributed, and/or supplied by the Promoter.

(f) If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

(g) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

(h) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) & Rabbitohs (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

ii. any theft, unauthorised access or third party interference;

iii. any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

iv. any variation in Prize value to that stated in these Terms;

v. if an Eligible Match or Game event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;

vi. any tax liability incurred by a winner or entrant;

vii. use of and/or taking of a Prize; or

viii. the participation of a Participant in any Game.

(i) As a condition of participating in a Game, and/or accepting a Prize, the winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

(j) Entrants are warned that there is a possibility of an accident causing injury through their participation in a Game. Any participation in a Game is undertaken at the Participant’s own risk. 

(k) The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://shop.rabbitohs.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia.

(l) The Promoter’s decision relating to all aspects of this Promotion is final and no correspondence will be entered into.
